Mr. Rooter Of Pittsburgh Breached Their Contract Created With A Non-Customer To Repair Damage To Property

Mr. Rooter of Pittsburgh/Cranberry continues to engage in unethical and irresponsible behavior.  Shocked?  Unfortunately, I am not shocked.  I've observed heinous behavior implemented by Mr. Rooter of Pittsburgh/Cranberry consistently for a little over 2 1/2 years.  Beware because the owner of Mr. Rooter of Pittsburgh/Cranberry also owns Mr. Rooter of Youngstown Ohio and Mr. Rooter of Dayton Ohio....Same owner, same process. 

So, not only does Mr. Rooter of Pittsburgh breach contracts with people who call them for service (their so-called "valued customers"), apparently, they are also in the business of breaching contracts with people who did not call them for service.  In addition to breaching a contract on the business end, there are criminal actions that appear to be in play here.  I am NOT a lawyer; however, if you were not invited onto the property and damage it without taking responsibility to repair the damage, and then ignore the homeowner when they call you...That looks like intentional criminal activity to me....

Linda's Facebook post reads:

"Mr Rooter parked in our yard while working at our neighbor's house in January 2014. They left big ruts in our yard and we have a receipt from them stating they would return in the spring to repair the damage. Police report was also filed and we have pictures. 5 calls since early May to a very nice lady but no one returns our calls. If Mr Rooter can't deliver a wheelbarrow of dirt and some grass seed, how confident are you in trusting them to repair your sewer lines???? Next step is local news station.... I posted this same statement on my FB page and many replies of will never use Mr Rooter in the future."

Linda also posted a copy of the invoice that she was given by an employee of Mr. Rooter of Pittsburgh:

What I noticed about the above, and currently breached, contract is that they have finally added their PA HIC# like they were supposed to have been doing since 2009 when the Home Improvement Consumer Protection Act was passed.  In a Rip Off Report, I provide examples of how I believe that they have violated the Home Improvement Consumer Protection Act.  I guess maybe their lawyer advised them that they were in violation at least on that point where their contracts could be considered void.  In a press release by the Attorney General on May 20, 2013, it reads:

Attorney General reminds contractors: they have a deadline to re-register as required by Home Improvement Consumer Protection Act

HARRISBURG - Attorney General Kathleen Kane is reminding contractors to re-register with the Attorney General's Office, in order to comply with the Home Improvement Consumer Protection Act, which took effect July 1, 2009. The majority of contractors' registrations will need to be renewed by July 1, 2013 so they may legally continue to perform home improvement services.

In 2008, the Pennsylvania Legislature passed the Home Improvement Consumer Protection Act.  The law requires that all contractors who perform $5,000 or more in home improvements in a year must register with the Attorney General's Office. Every two years, contractors are required to re-register within 30 days of their original registration date's expiration.

The law also requires contractors to maintain minimum insurance coverage and use contracts that contain important information about home projects, including the start date and completion date, a description of work being performed and consumers' rights under the law.

The Attorney General's Office has worked to ensure that the registration process is as quick and easy as possible for contractors. Re-registration can be done online at https://hic.attorneygeneral.gov/login.aspx or by submitting a completed application form to Pennsylvania Office of Attorney General, Bureau of Consumer Protection, ATTN: Home Improvement Contractor Registration, 15th Floor, Strawberry Square, Harrisburg, PA, 17120.  Forms are available online or by calling 717-772-2425.

Contractors are encouraged to re-register online and will continue to use their previously issued registration number. A registration certificate will also be issued by mail.

Kane also reminded contractors that the registration number must be included in any advertisements, contracts, estimates, and proposals that you use in Pennsylvania. In addition to registering with the Office of Attorney General, home improvement contractors must review HICPA and use contracts that comply with the requirements set forth in the law.  Failure to comply with HICPA can lead to civil and criminal penalties; and, may result in your contract being voidable and unenforceable.

Just because they have the HIC# on their contracts now, does not mean that Mr. Rooter has turned a new leaf into responsible and ethical business practices .  This just means that they want their contracts to be upheld so that they don't get fined by the Attorney General and people don't take them to court to have the contracts voided and possibly be forced to return the money they took under false pretenses and incompetence because the contracts would be unenforceable.

If Bob Beall was interested in demonstrating ethical or responsible business practices, then he would have addressed the serious complaints that have been published against him.  If Bob Beall and his business were responsible and ethical, then he would make right the wrongs of his business.

Recently, this website refers to this owner's businesses above:  http://www.plumbing-pittsburgh.com - an umbrella for all of the areas that he has declared to be officially serving; however, I recall them serving Ohio before they had officially bought the area.  

Technically, there have been several different websites they have used to switch things up and get search engines to bury the truth about their unethical business practices which have been reported by myself, other consumers, and even their former employees:  False Advertising; Breach of Contract, Shoddy Workmanship; and Nearly Non-Existent Customer Service.
