Mr. Rooter of Youngstown Is Getting Sued By The Ohio Attorney General

Figures that Mr. Rooter of Youngstown is getting sued by the Attorney General in Ohio.  Details can be found at:  The owner of this location is Robert "Bob" A. Beall.  Bob Beall owns multiple locations (Pittsburgh, Youngstown, Dayton, Weirton, Erie, Johnstown), also DBA as Rooter Champion near Mr. Rooter Locations and in North Carolina and possibly Florida, has a criminal record for trespassing on his neighbor's property at 1:30am to assault him, and is absolutely content with breaching contracts and other such activities.

It is not safe for anyone to do business with Mr. Rooter or any Dwyer Group brand.  Do your research and avoid, avoid, avoid!

Also, in order to stop the constant stream of complaints that Mr. Rooter LLC gets on their social media pages about their franchisees, they don't allow anything through that doesn't paint them in a positive light - Like the fact that the Ohio Attorney General is suing them.

"Mr. Rooter is doing business as Rooter Champion and Scamming Consumers"

Mr. Rooter franchise owner, Bob Beall, wanted to open up another plumbing business location in North Carolina, but he didn't want to pay Mr. Rooter LLC or The Dwyer Group their share of their business model that he is using to run it.  

Even though his contract as a franchise owner with Mr. Rooter LLC clearly indicates that he cannot open a company where there is already a Mr. Rooter location present, he ignored his franchise agreement and opened a plumbing business anyway called Rooter Champion.  I guess Mr. Rooter LLC is totally ok with this.  

Rooter Champion is being run at his Mr. Rooter franchise location in Cranberry, Pennsylvania.  Bob Beall has a partner in the business whose name is on the CC used for expenses and he put the company in is son's name so that he doesn't get caught by Mr. Rooter.  His son is still in school.  The dispatch and CSR part of the business is handled by a cell phone in the Mr. Rooter of Pittsburgh office.  Only a select few employees are trusted to handle Rooter Champion.  Mr. Rooter Champion dispatch and CSR employees answer the phone with a different greeting than the Mr. Rooter phone and claim no affiliation with Mr. Rooter when speaking to customers. 

There is strong evidence to support that, not only is he running Rooter Champion in North Carolina, he is also running Rooter Champion in Pittsburgh and probably his other locations in Youngstown, Dayton, and Weirton.

One word comes to mind for me:  FRAUD

Apparently FRAUD is completely acceptable to Mr. Rooter LLC.  As you can see over the last three years, I have posted evidence of Bob Beall (and them) engaging in fraud and...nothing!

It appears that everything that Bob Beall touches he ruins because Rooter Champion in North Carolina already has complaints with the BBB.  It is so helpful that the BBB is trying to emulate Angie's List because you can see for yourself the lies being told to people in North Carolina.

So, I decided to take a chance and actually tell Mr. Rooter LLC about how Bob Beall broke their franchising agreement through the corporate website. I was shocked to pretty much immediately get a call back from...ROOTER CHAMPION. Essentially, any leads they get from Mr. Rooter's website, they are taking as leads for Rooter Champion. This confirms what I thought he was doing. He drug Mr. Rooter's name through the mud, so now he is creating a new persona in order to trick the public into thinking he is a different plumbing company with different employees. So, Pittsburgh, Youngstown, Dayton, Weirton, and Charlotte...Look out! She left a message and couldn't even finish what their phone number was....Here is the message that was left immediately after I sent a message through corporate's website...

It is ironic that doing business with AT & T was "too hard" for her.  When, in reality, doing business with Mary Kennedy Thompson, or anyone within The Dwyer Group and their service brands is the true definition of "too hard."  It is too hard to compel them to take an ethical course of action.

As The President of Mr. Rooter Corporation (Mr. Rooter LLC) and The Executive Vice President of The Dwyer Group, Mary Kennedy Thompson, doesn't like to feel like she is getting ripped off; YET, it is 100% acceptable if she helps her franchisees rip off consumers by:

1) Engaging in False Advertising:  

Mary Thompson personally and publicly congratulated Mr. Rooter of Pittsburgh for winning the Angie's List Super Service Award except for the fact that THEY DID NOT!

2) Engaging in Fraudulent Misrepresentation:  

Mary Thompson supports the acquisition of franchisees who have criminal records and the retention of those who acquire criminal records as a franchisee, in addition to hiring individuals with criminal records who are sent into people's homes without their knowledge.  Some of the employees they send to your home aren't even plumbers or with anyone qualified to supervise them.

Mary Thompson supports their franchisees when they send a criminal to a consumer's home who pulls a bait & switch scam on a consumer - not only does the employee change the contract, he includes papers that the consumer had no idea existed until she came home AFTER they were signed which signed the consumer's rights away.  The employee made the person signing those papers feel as as they were part of the contract.

3) Engaging in Breach of Contract:

Several material breaches occurred on all three contracts.  Not only do the contracts not adhere to the Home Improvement Protection Act of PA, there is evidence of breach of contract via a camera inspection done by another company.

4) Engaging in Shoddy Workmanship:

Even with evidence, they still refused to repair/refund their shoddy workmanship and there are photographs and videos to illustrate their shoddy workmanship.

5) Engage in poor customer service practices:

The first course of action is to ignore the consumer.  Then, the next course of action is to tell them that you will talk to them personally about the serious issues that have been put online for which there is evidence.  Next course of action is to call the consumer, ask them questions, and then proceed to talk over them for 1/2 hour.  Subsequently, tell their customer that she would be willing to talk to her and then ignore her when she submits evidence.

The Better Business Bureau of Western Pennsylvania - BBB - Deceiving Consumers About Nature Of Complaints Received

*UPDATE 3-9-2015:  The BBB has seemingly redeposited complaints back into their original areas which now contain 4 categories...1) Complaint resolved through BBB Process 2) Complaint resolved with BBB assistance 3) Customer not satisfied with business response; BBB did not find business made good faith effort to resolve complaint 4) BBB found business made good faith effort to resolve complaint but customer not satisfied with business response.  IT IS MY OPINION that this location does not read or comprehend the nature of complaints that come through.  In Mr. Rooter's correspondence, they did not answer or respond to any of the questions posed; yet, the BBB still considered the complaint to fall into the 4th category instead of the 3rd category where our complaint should have been filed.  With regard to Mr. Rooter of Pittsburgh, anyone in the 4th category got shafted by both the business and the BBB of Western PA.  SUBMIT COMPLAINTS TO THE ATTORNEY GENERAL and WTAE INVESTIGATIONS.  A high volume of complaints may lead to investigation*

As of January 13, 2015...The BBB of Western Pennsylvania had the three categories below:

1) BBB found business made good faith effort to resolve complaint but customer not
satisfied with business response complaints.  

This is the category that they place complaints in IF the business responded to the complaint that the BBB forwarded to the business, but no resolution was reached.  The BBB considers a good faith effort to resolve a complaint to include merely JUST responding.  If there was any deductive reasoning applied, then some of the complaints, including ours, would not have been filed under this category to begin with.  If there is no resolution reached in 30 days between the consumer and the business, then this is the category where those complaints get dumped.  Complaints do not get filed here because the business ACTUALLY makes a good faith effort to resolve the complaint - at least not in the case with Mr. Rooter Plumbing of Pittsburgh.  

In fact, for the BBB serving Mr. Rooter of Youngstown Ohio...They declared that Robert "Bob" Beall's franchise (same owner of Mr. Rooter Plumbing of Pittsburgh) was not making an effort to resolve complaints.  The BBB serving the Youngstown Ohio area would be an example of what the BBB would look like doing their job to build trust between businesses and consumers - This is not the case for the BBB of Western Pennsylvania, though.  

It appears, as of today, that they deleted this category and placed all the UNRESOLVED COMPLAINTS from this category into to the resolved category without actually being resolved.  If both sides are NOT happy, then it is NOT RESOLVED.  PERIOD.  I can tell you for a FACT that Mr. Rooter Plumbing of Pittsburgh has no intention of nor did they ever have any intention of resolving complaints with those individuals whose complaints where dumped into this meaningless category.  My Mother has not been contacted or sent restitution and I guarantee that other consumers who were in the same category would be furious to find out that consumers will think that their complaint was resolved by the business.

Credit should NOT be given to a business when it isn't earned or deserved. 

Mr. Rooter of Pittsburgh has only resolved 62%-63% of the complaints filed against it.  That is a huge risk, as a consumer, to take on a business like this one.  Only 38 complaints have been resolved - NOT 50!!!!!!!

2) Complaint Resolved With BBB Assistance 

Keep in mind that the BBB doesn't really "assist" consumers.  They are nothing more than a forwarding service - not a place where real solutions happen.  You just get lucky if the owner thinks it sounds bad enough to resolve.  

3) The Business Failed To Resolve The Complaint Issues

This is the category that our complaint (and 11 others) belong to.

The BBB's actions will mislead consumers into thinking that the owner of several locations in the PA, OH, and WV area makes an effort to resolve most of the complaints and that is simply NOT TRUE!

*******ATTENTION*******  Mr. Rooter of Pittsburgh has changed their address to the address of Mr. Rooter LLC, their corporate company - even while keeping their email address and Pittsburgh phone numbers...I believe that they did that to hide their entry from consumer searches.  Their entry is:  Notice it has "in-waco-tx" in the link line?  Consumers being served by Mr. Rooter of Pittsburgh will never find the truth.  

*****UPDATE ON ADDRESS CHANGE****  It appears that Mr. Rooter of Pittsburgh's entry with the BBB now represents their correct address again.

In my opinion, the BBB and Mr. Rooter of Pittsburgh have exhibited shady behaviors and should not be trusted.

Attorney General and the FTC are where all complaints against Mr. Rooter locations and other Dwyer Group brands should get filed - These are the entities that, depending on the the number of complaints, will conduct an investigation and have the authority to take legal action against them to protect consumers from their unethical and predatory business practices.

Mr. Rooter Plumbing and Drain Cleaning Schaumburg, Illinois

When businesses publicly post on their Facebook pages, they do it so that their content will be shared.

Well, I shared the business' content.

While sharing the business' content, I have also shared my opinion and my concern for the general public.  Apparently, I have no right to have an opinion if it was a negative opinion because it was reported as spam by some man or woman and removed from Facebook entirely.  I have experienced, read others' experiences online, and have chatted with people who have horrible stories about several Mr. Rooter locations as customers and employees - Mr. Rooter Plumbing Schaumburg, Illinois is one of those locations.

Come on... Mr. Rooter is offering you $100 cash for a referral IF the person you referred buys and pays in full for a service recommended by their sales people, then you know the prices they charge are going to be exorbitant.  It sounds like a desperate plea for customers.

If a business is a good business, then you don't need to bribe people to refer you - it will happen naturally through word of mouth.

Do good people, like the franchisee who owns Pittsburgh, Ohio, and West Virginia territories, trespass on their neighbor's property with a pipe wrench and then attack him when he wants to know what he is doing?  Nope....

Boycotting Mr. Rooter Plumbing - Society's Only Hope!

In an attempt to add a little bit fun to the delivery of this useful consumer information, Sophie will tell you why boycotting Mr. Rooter Plumbing is necessary:  

Proof of false advertising by Mr. Rooter Plumbing that was supported by Mr. Rooter LLC and believed to be silently supported by The Dwyer Group AND the reasoning behind why organizing a boycott could be effective:

Why Would Boycotting Mr. Rooter Plumbing Be Effective?  
In 2012, Dina Dwyer-Owens made the statement, on National TV, that Mr. Rooter Plumbing was The Dwyer Group’s largest brand out of their seven service brands – bringing in about 27% of their revenue.  Today, The Dwyer Group claims to be close to bringing in 1 billion dollars in revenue at the end of 2014.  Based on the percentage of revenue that the Mr. Rooter Plumbing brand brings in for the The Dwyer Group, Mr. Rooter Plumbing could potentially be bringing The Dwyer Group $243 million dollars or more, give or take, of their total revenue.
I hypothesize that many of the franchisees within the Mr. Rooter Plumbing brand have permanently alienated at least 1% or more of the consumer population that they have served and will serve in the future consisting of both first-time and repeat customers due to the way they have implemented their “proven” system – AKA:  Their unethical business practices.

According to a former Mr. Rooter employee, it is against The Dwyer Group's policy to employ people with criminal backgrounds because the insurance will not cover them having access to customer's homes.  This puts the consumer, who chooses a Mr. Rooter location who does not follow this policy, in GRAVE DANGER

The owner of Mr. Rooter Plumbing of Pittsburgh/Mr. Rooter of Youngstown/Mr. Rooter of Dayton/Mr. Rooter of Weirton, Robert "Bob" A. Beall has a criminal record of criminal trespass and simple assault (charges reduced in a plea deal of course for a lighter punishment committed in June 2014 and adjucated in October 2014 ).  Some of Bob Beall's top employees who are working for him also have criminal records with guilty pleas and convictions like the people who were on our property during their dates of "service":  (Joe) has a criminal charge of theft and who was instrumental in the bait & switch tactic and our first point of contact with Mr. Rooter Plumbing of Pittsburgh; (Earl/Buddy) has multiple occurrences of criminal behavior criminal conspiracy engaging, simple assault, criminal tres-enter structure; retail theft; disorderly conduct; use/poss of drug paraph; tamper w/fabricate phys'l evidence from 1998-2005...This makes sense because Earl/Buddy is the one who told my Mother that she would be getting a full sewer line replacement to the main and everything restored back to the way they found it for $10,000 on the phone and then changed the terms of the contract after he got off the phone with her and never told her about the papers he was slipping in that waived her consumer rights which she had no knowledge of or would not have consented to. (Earl's 1/2 Brother, Jamie) was the hydrojetting technician who was also instrumental in Mr. Rooter's con who has engaged in: criminal conspiracy engaging - robbery, int poss contr subst per not reg, retail theft, recklessly endangering another person, manuf/del/poss/w int manuf or del, driving while oper priv susp or revoked.

Unethical and deceptive business practices are the norm for Robert "Bob" A. Beall's businesses and for owners at other Mr. Rooter locations.  Think about it....In order to be successful and make a living as reported by many former employees of multiple locations, you have to rip consumers off.  This has been stated by former employees who used to work for Robert "Bob" A. Beall and for other owners of Mr. Rooter franchise locations.  
IF all of Mr. Rooter Plumbing’s customers who have had negative experiences could come together with as much documentation as possible and share our experiences online via social media (Facebook, Twitter, Instagram, Youtube, Pinterest, Reddit, etc.)…THEN we might have a shot at raising awareness of Mr. Rooter Plumbing’s unethical business practices and save someone else from making the same mistake because the internet has the potential to be a powerful vehicle for change.
IF all of Mr. Rooter Plumbing’s customers who have had negative experiences could come together with as much documentation as possible…THEN we might have a shot at a class action suit – There are people on the Facebook page who are interested in starting a class action suit.
IF all of Mr. Rooter Plumbing’s customers who have had negative experiences could come together with as much documentation as possible and share our experiences online by submitting evidence to major news stations…THEN we might have a shot at raising awareness of Mr. Rooter Plumbing’s unethical business practices and save someone else from making the same mistake because the internet has the potential to be a powerful vehicle for change.
I am not against any business making money or even Mr. Rooter Plumbing marketing themselves as an “elite,” otherwise known as a price gouging, plumbing service; however, I am against a business extorting money from consumers through deceptive business practices and without providing the products and services promised in both oral and written contracts made between employees who are hopefully minimally qualified as MASTER PLUMBERS.
So, how does Mr. Rooter Plumbing LLC and their franchisees conduct business?
On the consumer’s end, it looks something like this:
1) False Advertising:

Mr. Rooter Plumbing of Pittsburgh’s False Advertising February 2012:  Mr. Rooter Plumbing of Pittsburgh stated in their commercial that they they will “do it right the first time.”  That couldn’t be further than the truth – In fact, they didn’t do their job at all based on my personal experience and the experiences reported by others.

Mr. Rooter LLC & Mr. Rooter Plumbing of Pittsburgh Advertising False Promises To Consumers:  From 2012-2014, Mr. Rooter LLC and Mr. Rooter Plumbing franchisees have publicly promised to have your plumbing maintenance/issues “fixed right the first time.”  The reality has been and still is that you will be lucky if your problem is fixed at all.  You can expect to never to get hold of anyone at Mr. Rooter Plumbing of Pittsburgh/Youngstown/Ohio if you have a problem.  You can expect to have Mr. Rooter LLC tell you to send a private message about your issue and they will get back to you, but they rarely ever do.  If Mr. Rooter LLC does get back to you, they will usually tell you that they can’t do anything and connect you with the franchisee – Yes, the franchisee who you had absolutely no luck with the first time around.

12-2014 Mr Rooter LLC Why Choose Our Plumbers: Notice what Mr. Rooter LLC and their franchisees are now advertising above.  Some of these advertised promises are unlikely to occur.  1) Know and adhere to all local codes (That is not always true based on what people have shared online – People have reported code issues.  Not all plumbers that come to your home in all states have to have a license, but rather they just need to be working for a Master plumber.); 2) Permanent plumbing repair solutions (So, they removed “fixed right the first time” and added this statement instead.  “Fixed right the first time” sounds like pretty permanent solution to me.  If Mr. Rooter is going to price themselves 2, 3, or 4 times the industry average, then there should be an absolute certainty that the problem you called about is taken care of promptly and permanently according to industry standards.) 3) Workmanship & parts guaranteed (There has been a fail in this department as well.  If workmanship & parts were guaranteed, then contracts wouldn’t be broken and there wouldn’t be pictures of shoddy workmanship on the internet by myself and others before and after me.)

The Mr. Rooter World Class Customer Service Experience - The Real Deal
The Mr. Rooter World Class Customer Service Experience – The Real Deal: Mr. Rooter of Pittsburgh does not return calls nor do they make any effort to listen to the issues of their customers and review the evidence presented in order to decide what might be considered a fair and equitable resolution.  Mr. Rooter LLC directs consumers to message them privately with contact information and promises to get back to them; yet, months…years go by and consumers never hear anything. There is typically NO customer service for anyone who has an issue at the local or corporate level.  Using Mr. Rooter is a risk.
The most important thing that I want consumers to realize is that Mr. Rooter LLC and at least one of their franchisees, Mr. Rooter of Pittsburgh, have INTENTIONALLY engaged in false advertising.  IF a business is willing to falsify receiving awards, THEN what else are Mr. Rooter LLC and their franchisees willing to lie to consumers about?  Probably everything.
There is proof online through forums and social media that Mr. Rooter Plumbing has engaged in misrepresentation, breach of contract, shoddy workmanship, and have refused and continue to refuse to make their wrongs right.  
For those consumers living in an area served by Mr. Rooter of Pittsburgh/Youngstown/Weirton/Dayton areas, the complaints (39) submitted to the BBB in the LAST 12 MONTHS represent 62% of the total complaints (63) submitted to the BBB in the last three years.  This serves as evidence, to me, that they have continued to engage in unethical business practices at a more prolific rate.
